Pool compliance refers to ensuring your pool barrier meets the safety standards outlined in State Safety Laws. These laws are in place to prevent drowning and serious injuries, particularly for young children. Compliance is mandatory for all pools with water depth exceeding 300mm.

All properties with a regulated pool are required by law to be protected by a compliant barrier. Compliance is evidenced with an active Pool Safety Certificate – Form 23. These are valid for 2 years from date of issue.

A pool safety certificate is valid for:

  • 1 year for shared pools (e.g., in unit complexes, hotels, motels).
  • 2 years for private backyard pools.

Any pool that can hold more than 300mm of water requires a certificate. This includes in-ground pools, above-ground pools, spa pools, and portable pools.

A pool safety inspection involves a licensed pool safety inspector assessing the compliance of your pool barrier against Pool Safety Standards. This includes checking:

  • Fence height and strength.
  • Gate operation and latching.
  • Non-climbable zones (NCZs).
  • Window and door compliance.
  • Signage and resuscitation charts.

The duration of an inspection depends on the complexity of the pool and barrier, but it typically takes between 30 to 60 minutes.

If your pool fails the inspection, you will receive a Non-conformity Notice detailing the required rectification work. You will have a specified timeframe (90 days) to address these issues and schedule a re-inspection.

Some minor issues may be fixable yourself. However, it's recommended to use qualified tradespeople for significant repairs or modifications.

Pool owners, including bodies corporate, are responsible for making sure their pool barrier always meets pool safety standards. Failing to do so could lead to a fine of more than $26,000.

Further, home Insurance policies may be void if it is found there was no active safety certificate over the pool registered to the property.

No, only licensed pool safety inspectors can conduct pool safety inspections and issue pool safety certificates in Queensland.

The Queensland Building and Construction Commission (QBCC) is the regulatory body responsible for overseeing pool safety laws in Queensland.

$250 for the onsite inspection and report plus a $45 QBCC pool register fee when deemed satisfactory. Total $295 + GST - Pool owners are encouraged to see this as a worthwhile investment into prevention, not prejudice.

Absolutely. If your barrier is also your boundary fence (very common) and it has been deemed compliant from the approach side (neighbours side) then, if they place climbable items (think trampoline, garden beds, wheelie bins etc) within the 1200mm NCZ then the effectiveness of your pools’ barrier is immediately compromised and you are at risk. A professional report issued by our licenced inspectors can help broach the subject with your neighbour.
